These Terms of Service (“Terms”) govern access to and use of NamaVU (the “Service”), operated by Peyman Babazadeh at 3111 34 AV NW, Calgary, Canada (“NamaVU”, “we”, “us”, “our”). By accessing or using the Service, you agree to these Terms.
1. Nature of the Service
NamaVU is a service that provides metadata and ratings information for entertainment content. We do not provide streaming content, video files, or direct access to copyrighted material. We help you organize and discover content available through legal sources.
2. No Affiliation
NamaVU is an independent project and is not affiliated with, associated with, authorized by, endorsed by, or officially connected with any third-party services or content providers mentioned or implied. All trademarks and names belong to their respective owners.
3. Third-Party Services
The Service may display data from third-party sources or link to third-party providers. NamaVU does not control these third parties and does not guarantee their availability, accuracy, or continued functionality. Your use of third-party services is subject to their respective terms and policies.
4. Acceptable Use
You agree to use the Service only for lawful purposes. You must not use the Service to:
- Infringe upon the intellectual property rights of others.
- Access content you are not authorized to access.
- Violate any applicable local, provincial, national, or international law.
- Attempt to bypass or break any security mechanism of the Service.
5. Fees, Billing, and Cancellations
Fees: Subscription fees are billed in CAD on a monthly recurring basis. Use of the Service requires a valid payment method.
Cancellations: You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. No further charges will be applied.
Refunds: Generally, fees are non-refundable for partial months of service, as access is provided for the full billing cycle. Exceptions may be made in cases of technical failure where the Service was unusable and support was unable to resolve the issue.
6. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NamaVU does not warrant uninterrupted, secure, or error-free operation.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAMAVU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.
8. Governing Law
These Terms are governed by the laws of Alberta and the applicable federal laws of Canada. Any dispute will be brought in the courts located in Calgary, Alberta, Canada.
